THE FOLLOWING RELEASE AND INDEMNITY AGREEMENT MUST BE READ, FILLED IN, SIGNED, AND RETURNED to Sunstreak Tours, 4 Delaware Rd., Morristown, NJ 07960, for your reservation to be finalized. THANK YOU.

RELEASE & INDEMNIFICATION.  I understand that Sunstreak Tours, Inc. (nor its employees), as the tour operator, does not act as agent for any person, firm, or corporation providing transportation, accommodation, or services on the tour.  I knowingly and voluntarily waive, release, save, hold harmless and indemnify Sunstreak Tours, Inc., a New Jersey corporation, their agents, servants, employees, shareholders, officers, directors, attorneys and contractors, past, present and future, and their respective heirs, legal and personal representatives, successors and assigns (collectively, “Released Parties”), and all of their respective properties, assets and interests from, any and all claims, actions, causes of action, demands, rights, damages, costs, losses, liabilities, expenses, compensation, controversies, disputes, obligations, debts, dues and liens whatsoever, on account of, or in any way arising out of, any and all known or unknown, foreseen or unforeseen loss of life or personal injury, loss or damage to property, and the consequences thereof, directly or indirectly resulting from, incident to, in connection with, or arising out of my participation in the tour.  It is my intention that this agreement shall apply to all of the claims without limit and, to the fullest extent allowed by law, regardless of whether founded, in whole or in part, on any negligent act or omission of any of the released parties.  I understand that Sunstreak Tours accepts no responsibility for any loss, damage, expense, injury, or claim arising from any defect in any conveyance, vehicle, or accommodation provided by any such person, firm, or corporation providing transportation, accommodation, or service.  Neither shall Sunstreak Tours  be held responsible for any loss or expense due to delay caused by changes in transportation services, strikes, illness, weather, war, quarantine or other cause.  My indemnity obligations shall not apply to any Claims that are caused solely by the acts or omissions of a person other than myself.
   I understand that butterflying is a very weather dependent activity, that the quantity and quality of the butterflies we see may be severely impacted by adverse environmental conditions, either before or during the trip, and that Sunstreak Tours is not liable for any diminution of enjoyment caused by these conditions.
   I understand that butterflying often involves walking in vegetation off of established roads, trails or paths, that such activity is inherently riskier than walking on established paths, and that Sunstreak Tours is not responsible for accidents that may occur while engaged in such activity, including, but not limited to, falls, and confrontations with animals and insects, nor responsible for diseases and/or parasites that may be acquired while butterflying.
   I understand that in the event I experience a medical or personal emergency, I will be responsible for the cost of all needed transportation, medical services, and/or other services associated with this event.

PARTICIPANTS.  I am prepared to engage in modestly strenuous physical activity, generally involving hiking, often in the sun.  Except for health problems listed on the reverse, I am in good physical health and have no special needs. I understand that because the success of the tour is dependent upon group interaction, Sunstreak Tours reserves the right to either exclude or send home, any individual(s) whose behavior, in the sole view of the tour leader, is incompatible with others' enjoyment.

DISAGREEMENTS.  I agree that any and all controversies or claims, of any type, that I may have with the “Released Parties” shall be determined and settled by arbitration in Morristown, Morris County, New Jersey, in accordance with the rules of the American Arbitration Association then existing and applying the laws of the state of New Jersey.  Any award rendered by the arbitrator shall be final and binding upon each of the parties, and judgment thereon may be entered in any court having jurisdiction over the subject matter of the controversy.  This agreement to arbitrate does not waive or modify the release and indemnity stated in this agreement.  This release and indemnity agreement shall be governed by and construed under the laws of the state of New Jersey.  Venue for enforcement of this release and indemnity agreement shall be in Morris County, New Jersey.
